The EU AI Act is now in force, the UK is firming up its own approach, and your customers, partners, and insurers are starting to ask questions about how you use AI.

The Regulatory Landscape in 2026

Three major frameworks now shape AI governance for UK businesses:

1. The EU AI Act (In Force)

The world's first comprehensive AI law came into full effect in stages through 2025-2026. Even if you're a UK-only business, this matters — if you sell to EU customers, use EU-based AI services, or have EU partners, you're in scope.

Key provisions:

2. The UK Approach: Pro-Innovation, Sector-Led

The UK deliberately chose not to copy the EU AI Act. Instead, it's pursuing a principles-based approach through existing sector regulators:

  • FCA regulates AI in financial services
  • Ofcom handles AI in communications and media
  • CMA oversees competitive impacts of AI
  • ICO covers AI and data protection (already active under GDPR/UK GDPR)
  • HSE addresses AI safety in workplaces

Five cross-cutting principles guide all regulators: safety, transparency, fairness, accountability, and contestability.

What this means practically: There's no single UK "AI law" to comply with. Instead, you follow sector-specific guidance from whichever regulators cover your industry. The flexibility is both a strength and a source of ambiguity.

3. International Standards

ISO/IEC 42001 (AI Management Systems) has emerged as the de facto standard for demonstrating responsible AI governance. Think of it like ISO 27001 for AI — a framework for managing AI risks, with certification available.

Risk Classification: Where Does Your AI Sit?

The EU AI Act classifies AI systems by risk level. Even if you're not directly subject to EU law, this framework is becoming the default way to think about AI risk:

Unacceptable Risk (Banned)

  • Social scoring systems
  • AI that exploits vulnerabilities of specific groups
  • Real-time biometric identification in public spaces (with narrow exceptions)

Most UK businesses: Not relevant. You're unlikely to be building these.

High Risk

AI used in:

Everything else — spam filters, AI-powered search, recommendation engines, internal productivity tools. Minimal regulatory burden, but voluntary codes of practice are encouraged.

1. Map your AI systems

Create an inventory of every AI tool and system in your organisation:

  • What AI tools do staff use? (ChatGPT, Copilot, Gemini, custom agents)
  • What decisions do they inform or automate?
  • What data do they process?
  • Who supplies them?

You can't manage what you haven't mapped.

2. Classify risk levels

For each AI system, determine the risk classification. Most internal productivity tools will be minimal risk. But if AI influences hiring, pricing, credit, or customer treatment — look carefully.

3. Implement proportionate governance

For minimal/limited risk:

  • Acceptable use policy for staff
  • Basic transparency (tell customers when they're talking to AI)
  • Regular review of AI tool subscriptions and data handling

For high risk:

  • Documented risk assessment
  • Human oversight procedures (who reviews AI decisions?)

Additional obligations apply:

The AI Acceptable Use Policy: Your First Step

Every business using AI should have one. It doesn't need to be complex:

Core elements:

  1. Approved AI tools — which tools are sanctioned for business use?
  2. Data handling rules — what can and can't be input into AI systems?
  3. Decision boundaries — which decisions can AI make autonomously vs. requiring human review?
  4. Transparency requirements — when must you disclose AI use to customers?

2. Ignoring the EU AI Act because "we're a UK business"

If you have EU customers, EU suppliers, or use AI services hosted in the EU, elements of the Act may apply to you. Even if they don't directly, your larger clients will increasingly require AI governance documentation as part of procurement.

3. Treating AI governance as an IT problem

AI governance is a business risk issue. It belongs with senior leadership, not buried in the IT department. The CISO cares about data security; AI governance is about decision quality, fairness, and accountability.

4. Waiting for "final" regulations

The regulatory landscape will keep evolving. But the fundamentals — transparency, fairness, human oversight, accountability — won't change. Start with those principles and adapt as specifics emerge.
