If you deploy AI systems and serve EU customers, the EU AI Act applies to you—regardless of where your company is headquartered.

The high-risk AI system requirements come into force August 2, 2026. That's six months away. Here's what you actually need to do.

Why UK Businesses Can't Ignore This

Post-Brexit, many UK companies assume EU regulations don't apply. For AI, that's wrong.

The EU AI Act has extraterritorial reach. If your AI system's output is "used" within the EU—whether that's a recommendation engine serving French customers or an HR screening tool processing applications from German candidates—you're in scope.

Think of it like GDPR. British companies didn't get a free pass on data protection just because of Brexit. The same logic applies here.

The Risk Tiers: Where Does Your AI Sit?

The Act categorises AI systems into four risk levels:

Unacceptable Risk (Banned since February 2025)

  • Social scoring by governments
  • Real-time biometric surveillance in public spaces (with narrow exceptions)
  • Manipulation techniques targeting vulnerable groups
  • Emotion recognition in workplaces and schools

High Risk (Compliance required August 2026)

  • AI in recruitment, HR decisions, and worker management
  • Credit scoring and insurance pricing
  • Critical infrastructure management
  • Educational assessment and admissions
  • Law enforcement and border control tools
  • AI used in medical devices

Limited Risk (Transparency obligations)

  • Chatbots (must disclose they're AI)
  • Deepfake generators (must label output)
  • Emotion recognition systems (must inform users)

Minimal Risk (No specific obligations)

  • Spam filters, AI in video games, inventory optimisation
  • Most internal productivity tools

Most business AI falls into limited or minimal risk. But if you're using AI for hiring, lending, customer risk assessment, or infrastructure—you're likely high-risk.

The August 2026 Deadline: What High-Risk Means in Practice

If your AI system is classified as high-risk, you need:

1. Risk Management System

A documented, living process for identifying, analysing, and mitigating risks throughout the AI system's lifecycle. Not a one-off assessment—continuous monitoring.

2. Data Governance

Training data must be relevant, representative, and as error-free as practicable. You need to document your data sources and demonstrate that datasets don't encode prohibited biases.

3. Technical Documentation

Detailed records of how the system works: architecture, training methodology, performance metrics, intended purpose, and known limitations. Think of it as a product safety dossier for AI.

4. Record-Keeping and Logging

Automatic logging of system operations with sufficient detail to trace decisions. If someone challenges an AI-driven decision, you need an audit trail.

5. Transparency and User Information

Clear instructions for deployers (your customers or internal teams) explaining the system's capabilities, limitations, and intended use. Users who are subject to AI decisions must be informed.

6. Human Oversight

Mechanisms enabling human oversight of the AI system. This doesn't mean a human reviews every decision—but someone competent must be able to understand, monitor, and intervene when needed.

7. Accuracy, Robustness, and Cybersecurity

The system must achieve and maintain appropriate accuracy levels, be resilient to errors and adversarial attacks, and meet cybersecurity standards.

Practical Steps: Your 6-Month Compliance Roadmap

Month 1-2: Audit and Classify

  • Inventory every AI system in your organisation (including third-party tools)
  • Classify each by risk tier using the Act's annexes
  • Identify gaps between current documentation and requirements
  • Assign ownership — someone needs to be accountable

Month 3-4: Build the Framework

  • Create risk management processes for high-risk systems
  • Document training data provenance and governance procedures
  • Implement logging and monitoring capabilities
  • Draft technical documentation for each high-risk system

Month 5-6: Test and Refine

  • Conduct conformity assessments (self-assessment for most categories)
  • Test human oversight mechanisms
  • Train staff on new obligations and procedures
  • Engage legal counsel for final review

What About GPAI Models? (Already in Effect)

If you're building on general-purpose AI models (GPT, Claude, Gemini, etc.), note that GPAI provider obligations took effect August 2, 2025. The model providers (OpenAI, Anthropic, Google) bear the primary compliance burden here—but as a deployer, you should:

  • Understand which models you're using and their risk classifications
  • Ensure your use stays within the model's documented intended purpose
  • Maintain records of model versions and when you update them

The UK's Own AI Regulation

The UK hasn't been idle. While taking a "pro-innovation" approach compared to the EU's prescriptive rules, the UK government has:

  • Published the AI Safety Institute's evaluation frameworks
  • Issued sector-specific guidance through existing regulators (FCA, ICO, CMA)
  • Proposed the AI (Regulation) Bill with cross-sector principles

For UK businesses operating domestically only, the regulatory environment is lighter. But if you're building for compliance with the EU AI Act, you'll likely exceed UK requirements automatically.

Common Misconceptions

"We just use ChatGPT — we're fine." If you're using AI chatbots for customer service, you have transparency obligations (tell users they're talking to AI). If you've fine-tuned a model for high-risk decisions, you're in scope.

"Our AI vendor handles compliance." Providers and deployers have separate obligations. Even if your vendor is compliant, you have independent duties around transparency, human oversight, and risk management.

"The deadline might be extended." There's discussion about the Digital Omnibus potentially pushing some deadlines to 2027-2028. Don't bet on it. The core framework is settled, and starting now gives you competitive advantage regardless.

"AI governance is just bureaucracy." Companies with strong AI governance consistently report fewer incidents, better model performance, and higher user trust. It's operational excellence, not paperwork.

The Business Case for Early Compliance

Beyond avoiding fines (up to €35 million or 7% of global turnover), early compliance offers:

  • Competitive differentiation: "EU AI Act compliant" becomes a selling point
  • Better AI outcomes: The documentation and testing requirements genuinely improve system quality
  • Customer trust: Demonstrable AI governance builds confidence
  • Future-proofing: Global AI regulation is converging; comply once, benefit everywhere

The organisations that handle AI regulation well are those that treat it as an engineering discipline, not a legal checkbox exercise.
